Even after all the research and the months of re-working and re-editing, I thought I finally found a perfect trademark just for me. But, I celebrated too soon.
I will say this, somebody was really looking out for me. I mean like angels surrounded me. Let me explain.
I received a call from the director of the trademark department Monday. I was at work and by the time I got off, they were closed. I immediately called back the next morning. I was informed that the monarch butterfly is such a commonly used insect. If you look here or google there, you can see it. Which I did. In my thinking I thought the way I designed it that it would be different.
She reminded me a trademark is something that represents you and should be different. She said I could still use it, but there's a possibility that someone might try to sue me for trademark infringement. She even gave me a few ideas on what I could change. She said send in the paperwork with the same colors for the trademark changes. Luckily I don't have to send in another payment for the trademark. I just have to send in the items that the trademark will be used on and for. I was a bit bummed out, but I had to think of all the positives and focus less on the negatives. Pray that with more research and research that this new trademark will be all mine.
In the coming days l hope the trademark I have now will be my new one. I actually created two. One with a lavender background and one with a white background.
